Terms of Service

1. Eligibility

You must be at least the age required to form a legally binding contract in your jurisdiction. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration and Security

Certain features require account registration. You agree to provide accurate, complete, and current information and to update it as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

3. Description of Services

Cherry Pickers enables users to discover properties, view details, create property listings (where applicable), and submit ratings and reviews. We may modify, suspend, or discontinue any feature of the App at any time without liability.

4. User Content

The App may allow you to submit content including text, photos, ratings, reviews, and listings (“User Content”). You retain ownership of your User Content, but you are solely responsible for what you post and share through the App.

No tolerance for objectionable content or abusive behavior (zero tolerance).

You must not post, upload, share, or otherwise make available any User Content that is unlawful, harmful, or objectionable. This includes, for example:

• harassment, bullying, or threats toward any person,
• hate speech or discrimination,
• sexually explicit content or exploitation,
• violent or graphic content,
• content that encourages wrongdoing or self-harm,
• spam, scams, or misleading/fraudulent content,
• content that infringes on another person’s rights (including intellectual property or privacy).

You represent that you have all necessary rights to submit your User Content, and that your User Content does not violate any law or any third-party rights.

The App includes tools to help prevent abuse, including the ability to report content and block users. We may take action on reports, including removing content, restricting visibility, or suspending accounts.

5. License to User Content

By submitting User Content, you grant Cherry Pickers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting and display purposes), publish, and distribute such content solely for operating, improving, and promoting the App.

6. Acceptable Use

• Do not attempt to access non-public systems or data.
• Do not interfere with or disrupt the App’s functionality.
• Do not scrape, copy, or harvest data without permission.
• Do not impersonate any person or entity.

7. Content Moderation and Enforcement

We reserve the right (but are not obligated) to review, remove, hide, limit visibility of, or restrict access to any User Content or account that violates these Terms, our policies, or applicable laws.

To help prevent abuse, we may use automated systems, keyword filters, and moderation tools to detect and prevent the posting of objectionable or abusive content before or after it is published.

If we believe a user has posted objectionable content or engaged in abusive behavior, we may take actions including warning the user, removing content, limiting features, or suspending or terminating the account.

Users can report content and block other users within the App. Reporting helps us identify content that may violate these Terms. Blocking is intended to help users immediately stop interacting with abusive users.

8. Account Deletion

You may delete your account within the App. Upon confirmed deletion, your account data will be removed in accordance with our Privacy Policy, subject to legal and operational retention requirements.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

10. Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free, or that content (including user reviews) is accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, Cherry Pickers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Cherry Pickers operates, without regard to conflict of law principles.
